1 Eligibility
1.1 Use and Membership
Use and Membership are void where prohibited. You agree that you are of legal age, as required by all applicable statutes in the state and/or country you reside. You further agree that are at least 18 years of age or older.
1.2 Multiple Accounts
An individual or group may not have more than one account in use at any given time without express prior authorization from the legal team so they may link accounts in the database. This action will not be granted without a sufficiently justifiable reason. Any other member with multiple accounts will be subject to administrative action.
2 Terms of Agreement
2.1 Duration
This agreement will remain in full force and effect while you use this site and/or are a member. You may terminate your membership at any time, for any reason by contacting the website administrators or using the delete account option. FurriesXtreme may terminate your membership for any reason. Sections 13.1, 13.2, 13.3, 13.4, 13.5, 13.6, 13.7, 13.8, 13.9, 13.10, 13.11, 13.12, 13.13 as well as any other terms which by their nature should survive, will survive the termination of this Agreement.
2.2 Reporting Violations of the Terms of Service
Any user or member who reports a violation of the terms of service shall not be held liable for any damages or disruption of service caused to the user or member who has violated the terms of service.
3 Usage
3.1 Individual and Group use policy
FurriesXtreme may not be used by any other individual or group, including but not limited to, members of the press acting in a professional capacity, individuals or groups interested in prosecution, persecution, defamation upon the furry community at large and/or individuals in the furry community, or use within television, news paper, website, or any other form of media.
3.2 Illegal activity
Illegal and/or unauthorized uses of FurriesXtreme, including but not limited to, collecting usernames, email addresses, and/or other contact information of members for the purpose of sending unsolicited email, data mining, running "bots", running "scripts", accessing by proxy, attempting to get around an IP block, accessing an account that has been blocked by an IP ban, or any other use deemed illegal by any applicable laws where the user resides or within the FurriesXtreme, the greater extent of what is deemed illegal between the residence of the user and FurriesXtreme law will be applied, is expressly prohibited. Any such action will be immediately reported to the appropriate law enforcement officials.
3.3 Commercial Use
Commercial use is strictly prohibited and may result in administrative action against the account user. Additionally, any money received in connection to commercial use of FurriesXtreme maybe recovered by FurriesXtreme while enforcing a legal action, including but not limited to breach of contract.
4 Availability
FurriesXtreme makes no guarantee of the quality or duration of any and all features of FurriesXtreme. FurriesXtreme does not guarantee continuous, uninterrupted or secure access to any part of the website, and operation of the website may be interfered with by numerous factors outside of our control.
5 Content rights
5.1 Use of Data
5.1.1 Public Use
Data posted by members to FurriesXtreme remains the property of those members, and may not be in the public domain. As such you may not copy, redistribute or sell member information and/or pictures, with out explicit written permission from each member involved.
5.1.2 Private Use
FurriesXtreme reserves the right to use the content published to FurriesXtreme in any manner it sees fit in accordance with the laws of NJ and the United States of America. By posting data to FurriesXtreme, you agree to allow FurriesXtreme to store, analyze, redistribute, copy, and display your data to other members and site users, regardless of whether the information is marked public or private. By posting content to this site you give unlimited publication rights to FurriesXtreme and its agents. Publication rights terminate for FurriesXtreme once the content is removed by the poster on FurriesXtreme and notice is provided to legal@FurriesXtreme.com
5.2 Data Modification
FurriesXtreme and its associates reserves the right to remove, delete, censor, modify in part or entirely, and/or review any content, data, and/or messages, which are sent, or posted to FurriesXtreme. It is the sole judgment of FurriesXtreme how and which data may be posted.
5.3 Data Collection

5.5 Personal Information
Your member profile may not contain advertisements. Any personal information you post in your ad is at your own risk. You may not post personal information of any other individual on FurriesXtreme. FurriesXtreme may take administrative action in response.
5.6 Copyrighted/Trademarked Material
You may not post, distribute or reproduce copyrighted material, trademarks or other proprietary information using resources provided by FurriesXtreme without the explicit consent of the copyright and/or trademark holder. If you believe that data posted on FurriesXtreme violates a copyright or trademark on your work please contact the site’s legal team, at legal@FurriesXtreme.com, immediately to have the violation investigated. FurriesXtreme is not liable for users posting copyrighted, trademarked, or other proprietary information, however, FurriesXtreme will make efforts to remove such material once informed of a potential violation.
5.7 Minors
5.7.1 Contacting
The use of FurriesXtreme to contact minors is expressly prohibited. Any such actions will be immediately reported to the appropriate law enforcement officials.
5.7.2 Use/Accounts
The use/creation of an account on FurriesXtreme, by minors, is expressly prohibited. Any account found to be created by or believed to be operated by a minor will be removed immediately and subject to further administrative action
5.8 Libel/Defamation
The posting of any material which may or does constitute libel, libel per se, or defamation is expressly prohibited. Any user, member, and/or content found to violate this policy will be subject to immediate administrative action.
5.9 Offensive Content

You agree that you are fully responsible and liable for any results of posting explicit and/or adult content.
5.9.2 Other Offensive Content
FurriesXtreme does not control and is not responsible for content made available. By using FurriesXtreme, you agree that you may be exposed to content that you deem to be offensive, indecent, inaccurate, misleading, or otherwise objectionable and hold no right to legal action against FurriesXtreme for viewing such content. FurriesXtreme reserves the rights to all content of the chatroom linked from FurriesXtreme. Reproduction in part or in entirety of the content therein is expressly prohibited.
6 Communications with other Members
You are solely responsible for your communications and interactions with other members of FurriesXtreme. You understand that FurriesXtreme is not responsible or liable for the accuracy, content, or quality of interactions or communications between members and that any such communication or interactions has no expressed, implied, or statutory guarantees.
7 Harassment
Harassment of users or members of any type is explicitly prohibited. Examples of harassment include, but are not limited to, impersonation of any person or entity, threatening users or members, contacting users or members an excessive number of times, and repeatedly contacting users or members after receiving a request to stop. Users or members engaged in harassment are subject to any legal or administrative actions by FurriesXtreme, as well as, the harassed individual or group. Users/members who feel they are subject of harassment should immediately contact the legal team at legal@FurriesXtreme.com.
8 Unauthorized Access
8.1 Access to other Member’s Accounts
Attempting to or gaining access to member's accounts, which are not your own, by any means, is expressly prohibited. Such actions will immediately be reported to the appropriate law enforcement agency and subject to administrative action.
8.2 Access to FurriesXtreme's Computer Systems
Attempting to or gaining unauthorized access to FurriesXtreme's computer systems or engaging in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of computer systems in support of FurriesXtreme is expressly prohibited. You also agree not to alter, reproduce, adapt, distribute, display, publish, reverse engineer, translate, disassemble, decompile or otherwise attempt to create any source code which is derived from the software. You acknowledge that all rights, title and interest to FurriesXtreme's software are owned by FurriesXtreme. You are responsible for any damaged caused to the computer systems either physically or to the data contained therein, time lost in correcting such damage, and any other costs associated with such actions. Further, such actions will immediately be reported to the appropriate law enforcement agency and administrative actions may be taken.
9 Modification of Terms of Service
FurriesXtreme reserves the right to modify these Terms of Service at any time without notice. Continued use of FurriesXtreme, which includes, but is not limited to, browsing the website, logging into a member account, and viewing other member's posts or data, will constitute an acceptance of the new Terms of Service.
10 Conflicts
If a conflict arises between the rules posted on the website and the Terms of Service, the Terms of Service shall apply.
11 Donations
Donations are completely voluntary and no part of FurriesXtreme constitutes a pay for service website. Once a donation is made, it becomes the sole property of the FurriesXtreme website administrator and may be used to pay for any costs, past, present, or future, related in any way to the operation of FurriesXtreme
12 Administrative Action
FurriesXtreme and its associates reserve the right to take any administrative action without notice or reason given at any time to any user or member.
13 Legal Issues
13.1 Arbitration
For any claim, excluding claims for injunctive or other equitable relief, where the total amount of the award sought is less than $5,000.00 USD, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. If a party elects arbitration, that party will initiate such arbitration through an established alternative dispute resolution (ADR) provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of law.
13.2 Law and Forum for Disputes
Except as otherwise agreed by the parties you agree that any claim or dispute you may have against FurriesXtreme must be resolved by a court located in Middlesex, NJ. You agree to submit to the personal jurisdiction of the courts located within MiddleSex County, NJ for the purpose of litigating all such claims or disputes. This Agreement shall be governed in all respects by the laws of NJ, without regard to conflict of law provisions.
13.3 Improperly Filed Litigation
All claims you bring against FurriesXtreme must be resolved in accordance with section thirteen of the Terms of Service. All claims filed or brought contrary to section thirteen shall be considered improperly filed and a breach of the Terms of Service. Should you file a claim contrary to section thirteen, FurriesXtreme may recover all attorney's fees and costs, provided that FurriesXtreme has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
13.4 Waiver of Right to Trial by Jury
Users, members, FurriesXtreme, and FurriesXtreme associates waive the right to a trial by jury in any action, proceeding, or counterclaim brought by any party against any other arising out of or in any way related to the use of FurriesXtreme.
13.5 No Waiver
FurriesXtreme’s failure to act with respect to a breach of the Terms of Service, by you or others, does not waive our right to act with respect to subsequent or similar breaches.
13.6 Limitations of Liability
In no event shall FurriesXtreme or its associates be liable for lost profits or any special, incidental or consequential damaged arising out of or in connection with the website or this agreement including, but not limited to, negligence.
13.7 No Warranty
FurriesXtreme services are provided on an as is, where is basis and without any warranty or condition, express, implied or statutory. FurriesXtreme specifically disclaims any implied warranties of title, as to merchantability, fitness for a particular purpose, any other matter, or non-infringement.
13.8 Liability
If you do not comply with FurriesXtreme's implementation, use requirements, posted rules, and Terms of Service you will be liable for all resulting damages, including attorney’s fees, suffered by you, FurriesXtreme, FurriesXtreme’s associates and third parties.
13.9 Indemnification
You agree to defend, indemnify and hold FurriesXtreme and its associates harmless from any claim or demand (including attorneys fees) made or incurred by any third party due to or arising out of your breach of this Agreement and/or your use of the Services.
13.10 Cooperation with Law Enforcement and Courts of Law
13.10.1 Subpoenas
FurriesXtreme will comply with all properly produced subpoenas presented by a court of law. FurriesXtreme is not liable for any damages caused, directly, incidentally, or negligently, by the release of such information in compliance with such a subpoena.
13.10.2 Law Enforcement Investigations
FurriesXtreme may choose to comply with any request for information presented by Law Enforcement Officials without a subpoena. FurriesXtreme is not liable for any damages caused, directly, incidentally, or negligently, by the release or withholding of such information in response to such a request.
13.11 Release
If you have a dispute with one or more Users, you release FurriesXtreme and its associates from any and all claims, demands and damages, actual and consequential, of every kind and nature arising out of or in any way connected with such disputes.
13.12 Enforceability
If any provision of the Terms of Service is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
13.13 Final and Entire Agreement
These Terms of Service in addition to any rules posted on the website constitute the entire and final agreement between FurriesXtreme and Users/Members
